Welcome to Sunrise Jewelry and Gallery. These Terms of Use (the “Terms”) govern your use of sunrisejewelryusa.com (the “Site”) and your purchases from Sunrise Jewelry and Gallery (“Sunrise,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

Sunrise Jewelry and Gallery is a retail store in Old Town Scottsdale, Arizona, offering authentic Native American jewelry and gallery pieces since the 1990s. Our store is located at 7254 E Main St, Scottsdale, AZ 85251.

2. Product Descriptions and One-of-a-Kind Items

We work hard to describe and photograph every piece accurately. Please keep in mind:

Many of our pieces are one-of-a-kind or handmade. Slight variations in stones, silverwork, color, and finish are part of what makes handmade jewelry special, and are not defects.
Natural stones vary. Turquoise, White Buffalo, and other natural stones each have unique matrix, veining, and color. The piece you receive is the piece photographed unless the listing says otherwise, but photographs cannot capture every angle.
Screen colors differ. Colors on your monitor or phone may not exactly match the physical item.
Weights and measurements are approximate unless stated otherwise.

If a listing contains an error in description, we reserve the right to correct it. If you have already ordered an item that was materially misdescribed, you may cancel for a full refund.

3. Authenticity

We stand behind the authenticity of our inventory. Where an item is described as Native American made, or attributed to a specific artist, tribe, or nation (for example, Navajo or Zuni), that description reflects our good-faith representation based on our sourcing, documentation, and decades of experience, consistent with the federal Indian Arts and Crafts Act. Items described as “Old Pawn,” vintage, or estate pieces are described to the best of our knowledge based on their characteristics and provenance.

4. Pricing and Pricing Errors

All prices are in U.S. dollars and do not include shipping or applicable taxes, which are added at checkout.

Despite our best efforts, a small number of items may occasionally be mispriced. If an item’s correct price is higher than the price shown, we will contact you before shipping and give you the choice of paying the correct price or canceling for a full refund. We are not obligated to sell an item at an obviously erroneous price (for example, a $4,000 piece listed at $40 due to a typographical error), even after an order confirmation has been sent.

We may change prices at any time without notice. Price changes do not affect orders we have already accepted.

5. Orders and Order Acceptance

Placing an order through the Site is an offer to buy. Our order confirmation email acknowledges that we received your order — it is not acceptance. We accept your order when we ship the item (or, for in-store pickup, when we notify you the item is ready).

We may decline or cancel any order before acceptance for reasons including: the item is out of stock or was sold in-store before your online order processed (many pieces are one-of-a-kind and are sold in both places), a pricing or description error, suspected fraud, or a problem verifying payment. If we cancel your order, we will refund any amount you paid in full.

6. Payment

We accept the payment methods shown at checkout. By providing a payment method, you represent that you are authorized to use it. Your payment method is charged when you place your order; if we cancel the order, the charge is refunded.

7. Shipping and Risk of Loss

We ship to addresses within the United States. Contact us before ordering if you need international shipping.
Shipping costs and estimated timeframes are shown at checkout. Timeframes are estimates, not guarantees.
All shipments are insured and require a signature on delivery for higher-value items.
Title and risk of loss pass to you when the carrier delivers the package to your address. If a package arrives damaged or does not arrive, contact us right away at info@sunrisejewelryusa.com or 480-425-9944 and we will work with you and the carrier to resolve it.

8. Returns

We offer a 30-day money-back guarantee, subject to the terms of our [Refund Policy], which is part of these Terms.

9. Intellectual Property

All content on the Site — including text, product photographs, graphics, logos, and the “Sunrise Jewelry and Gallery” name — is owned by Sunrise or used with permission, and is protected by copyright and trademark law. You may not copy, reproduce, republish, or use our content for any commercial purpose without our written permission. You may share links to our pages and use our images solely as needed to view and consider our products.

Artist names and tribal designations are used to accurately describe the pieces we sell and do not imply endorsement of the Site by any artist, tribe, or nation.

10. Acceptable Use of the Site

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to any part of the Site or its systems; scrape, harvest, or copy Site content or product data in bulk; interfere with the Site’s operation; or impersonate another person when placing an order or contacting us.

11. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms or required by law, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.

Nothing in this section limits our authenticity representations in Section 3, our Refund Policy, or any warranty rights you have under applicable law that cannot be disclaimed.

12. Limitation of Liability

To the fullest extent permitted by law, Sunrise’s total liability to you for any claim arising out of these Terms, the Site, or a purchase is limited to the amount you paid for the item giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

Some states do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold Sunrise harmless from claims arising out of your violation of these Terms or your misuse of the Site.

14. Governing Law and Venue

These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any legal action must be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time you place an order governs that order. Continued use of the Site after changes are posted means you accept the updated Terms.

16. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Sunrise regarding the Site.
